Humanitarian and Compassionate Applications
Under section 25(1) of the Immigration and Refugee Protection Act .Humanitarian and compassionate consideration is an exceptional and discretionary option for certain foreign nationals in Canada who need exemptions from immigration requirements.
It is not a regular economic or family immigration program. Applicants must present sufficient and compelling evidence explaining why an exemption should be granted.
Important points:
- Applicants must clearly identify the exemptions they are requesting
- Supporting evidence should address the applicant’s complete circumstances
- The cost or inconvenience of returning to another country is generally not sufficient on its own
- Only one humanitarian and compassionate application may normally be under consideration at a time
- Submitting an application does not automatically stop removal from Canada
- Approval is never guaranteed
Applicants may be living outside Canada or may already be in Canada with valid temporary resident status.
