Refugee and Protected Persons Pathways
Canada offers protection to people who face persecution or serious harm in their home country.You qualify as a Convention refugee under IRPA s. 96 if you fear persecution because of your:
- Race
- Religion
- Nationality
- Political opinion
- Membership in a particular social group
You qualify as a person in need of protection under IRPA s. 97 if returning home would expose you to:
- Torture
- A risk to your life
- Cruel and unusual treatment or punishment
IRCC or CBSA first checks your eligibility. The Refugee Protection Division then reviews your evidence and decides your claim. An accepted claimant receives protected person status and has the right to apply for permanent residence.

A person in Canada may apply for permanent residence under the protected persons category after the Immigration and Refugee Board of Canada or IRCC determines that the person is a protected person or Convention refugee.

A refugee claim and a permanent residence application are separate processes. Making a refugee claim does not automatically result in permanent residence.

- A person recognized as a protected person by IRCC
